01Agreement to these terms

These Terms of Service (“Terms”) are an agreement between you and HistoryByVIN LLC (“HistoryByVIN”, “we”, “us”). They apply when you use historybyvin.com, our VIN check, VIN decoder, car loan calculator and any vehicle history report you buy (together, the “Service”).

By using the Service or buying a report, you agree to these Terms and to our Privacy Policy. If you don’t agree, please don’t use the Service.

02Who can use the Service

You must be at least 18 years old and able to enter a binding contract. If you use the Service for a business, such as a dealership, you confirm that you have authority to accept these Terms for that business.

03What a vehicle history report is

A report collects records connected to a Vehicle Identification Number (VIN) from third-party sources, such as title, insurance, auction, recall and service records. It helps you decide whether to look closer at a vehicle.

04Permitted use

Reports are for your own personal or internal business use when evaluating a vehicle. You agree not to:

• resell, republish or share reports in bulk, except as allowed in a dealer agreement
• use the Service to identify, locate or contact a vehicle owner or any other person
• use reports to decide eligibility for credit, insurance, employment or housing
• scrape, copy or automate access to the Service without our written permission
• break the law, including privacy and consumer protection laws

05Accounts

Some features need an account. Keep your login details private and tell us right away if you think someone else is using your account. You are responsible for activity under your account.

06Prices and payment

Prices are shown in US dollars before checkout and may change. Report packs (for example 3 or 5 reports) can be used for different vehicles and stay in your account. Payments are processed by our payment provider; we don’t store your full card number.

07Refunds

Because reports are delivered instantly, sales are generally final. We will review a refund request if:

• you were charged more than once for the same report
• the report could not be delivered because of a technical problem on our side
• no records were available and we did not tell you before purchase

Email support@historybyvin.com within 30 days of purchase with your order number and VIN.

08Free tools

The VIN decoder and car loan calculator are free estimates. Loan results depend on your lender, credit and state and are not a loan offer or financial advice.

09Intellectual property

The Service, its design, text and software belong to HistoryByVIN or its licensors. You receive a limited, non-transferable right to use reports under these Terms.

10Disclaimers

The Service is provided “as is” and “as available”. To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of accuracy, merchantability and fitness for a particular purpose.

11Limitation of liability

To the fullest extent the law allows, HistoryByVIN is not liable for indirect, incidental or consequential damages, or for decisions you make based on a report. Our total liability for any claim is limited to the amount you paid us for the report in question. Some states don’t allow these limits, so they may not apply to you.

12Changes and termination

We may update the Service or these Terms. If we make important changes we will update the date at the top of this page. We may suspend access if these Terms are broken.

13Governing law

These Terms are governed by the laws of the State of [State], without regard to conflict-of-law rules. Disputes will be handled in the state or federal courts located in [County, State], unless the law requires otherwise.
